California Sex Crime Laws

  • Indecent Exposure – Penal Code § 314: Willfully exposing one’s genitals in public or in the presence of another person for sexual gratification or to offend. Often charged as a misdemeanor, but can be a felony for repeat offenses or if minors are involved, with possible registration.
  • Sexual Battery – Penal Code § 243.4: Touching the intimate parts of another person against their will for purposes of sexual arousal, gratification, or abuse. Can be charged as a misdemeanor or felony, with potential requirement for sex offender registration.
  • Oral Copulation – Penal Code § 287: Any contact between the mouth of one person and the sexual organ or anus of another without consent, or with a minor under specified ages. Penalties depend on the victim’s age and whether force or coercion was involved.
  • Sodomy – Penal Code § 286: Sexual contact between the penis of one person and the anus of another when it is non-consensual, with minors, or under other prohibited circumstances. Felony penalties increase with the use of force, threats, or victim’s age.
  • Possession/Distribution of Child Pornography – Penal Code § 311 Series: Prohibits the possession, production, distribution, or advertising of visual depictions of minors engaged in sexual conduct. Generally charged as a felony with significant prison terms and mandatory registration.
  • Lewd or Lascivious Acts with a Minor – Penal Code § 288: Committing any lewd act upon a child under 14 with intent to arouse, appeal to, or gratify the sexual desires of either party. A serious felony with substantial prison terms and mandatory registration.
  • Continuous Sexual Abuse of a Child – Penal Code § 288.5: Engaging in three or more acts of sexual conduct with a child under 14 over a period of three months or more. A felony punishable by lengthy prison sentences and lifetime registration.
  • Rape – Penal Code § 261: Non-consensual sexual intercourse accomplished by force, threat, fraud, or when the victim is incapacitated or otherwise unable to consent. A felony carrying severe prison sentences and lifetime sex offender registration in most cases.
  • Sex Offender Registration Requirements – Penal Code § 290: Requires individuals convicted of certain sexual offenses to register with local law enforcement for life or for a set period based on offense tier. Failure to comply is a separate criminal offense.

Update July 7, 2026 at 7:42 am: Mental health diversion was actually available June 2018. I couldn't care less for their "empathy." Empathy changes nothing. Update June 25, 2026 at 11:33 am: It has been alleged that mental health diversion was not an available option at the time of my plea. I entered my plea in September 2018 and was sentenced January 2019. Mental health diversion was signed into law in July 2018. He would be performing a kindness for the local community by retiring. I retained Patrick Valencia in April 2018 to represent me in a criminal case. I had been accused of a crime by someone who raped me. I let Patrick Valencia know there was a strong mental health component to my case. I was unaware at the time that Santa Clara County had a mental health court, so when he claimed the best outcome was for me to plead to a felony, being inexperienced with the system I believed him and served three years' probation. The felony plea contributed in large part to my expulsion from University. Years later I was arrested for the same conduct concerning the same rapist and this time was represented by the Public Defender's Office at no charge to me. I received a much better outcome without having to spend $7500 on a retainer. I was granted mental health diversion and my charge was dismissed. I complained to the State Bar and Patrick Valencia, even after being notified I am aware of his misconduct, refuses to so much extend the courtesy of a refund even though he did NOTHING for me besides ruining my life. Not to mention, from serving three years' probation and being expelled from University I suffered massive financial losses. Thankfully a new law was passed, vacatur, where survivors of sexual violence can petition to have their rap sheet erased. But even so, nothing will repair the lost time and opportunities I suffered because of this shameful, incompetent rape apologist. Did I mention he screamed at me outside of the courtroom asking if I was a nasty woman? That's how he treats his clients. Steer clear from this firm. I notice I am not the only former client he has mistreated. I encourage all of this scoundrel's victims to report him to the State Bar.

Burdened no more I got myself placed on sex registry list in 1992 for a stupid indecent exposure rap and never really had a good birthday since. Finally found out I can possibly be taken off this list I tried it myself and got in way over my head. Free at last! I was stuck on the Sex Offender Registry for 29 years for a misdemeanor offense I committed in 1994. You can't live a normal life when you're stuck on the registry. Mr. Ippolito represented me in a very scary situation. I failed to register as a sex offender for last three yrs. after 27 yrs. of carefully following the law and thinking no one cared if I stopped. When I turned myself in I learned I was possibly facing 25 yrs. to life in prison for my negligence. I had recently started a good-paying position OTR truck-driving across the country and could not afford to be in jail or lose my job. Mr. Ippolito not only got me 3 yrs. probation, no jail time, a small fine and even drove 150mi. to the County I live in to face a 2nd judge and verify the stipulations of probation so I could keep my job. Believe me, Mr. I was worth every penny.
